Terms of Service

By downloading, installing, or using the Earthscale application ("Earthscale," "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

Earthscale is a local, on-device AI assistant. Every response you see is generated by a language model running directly on your device's hardware — Earthscale does not operate cloud AI infrastructure, and your conversations are not transmitted to Earthscale's servers or any third party for the purpose of generating a response.

You understand and agree that:

• Earthscale's responses are generated automatically by a machine learning model and may be inaccurate, incomplete, outdated, biased, offensive, or otherwise unsuitable for your purposes.
• Neither Earthscale, its creator(s), nor any affiliated party warrants the accuracy, reliability, safety, or appropriateness of any output generated by the App, under any circumstance.
• You are solely responsible for evaluating and verifying any AI-generated output before relying on it, acting on it, sharing it, or using it for any purpose — including but not limited to medical, legal, financial, safety-critical, or professional decisions.
• Earthscale is not a substitute for professional advice of any kind (medical, legal, financial, psychiatric, or otherwise), and the App is not intended to diagnose, treat, or provide emergency assistance. If you are experiencing a medical or safety emergency, contact emergency services directly.
• Earthscale, its creator(s), and its affiliates disclaim all liability, to the fullest extent permitted by law, for any damages, losses, or consequences — direct, indirect, incidental, consequential, or otherwise — arising from or related to any content generated by the App, or any action taken based on it.

• Earthscale enables you to download and run open-weight language and vision-language models published by third parties (including, but not limited to, model publishers such as Qwen and ggml-org).
• Earthscale does not own, author, or claim any intellectual property rights in these models. Each model remains the property of its original creator(s) and is distributed subject to its own license (e.g., Apache 2.0), which you are responsible for reviewing and complying with. Earthscale's role is limited to providing a mechanism to download, run, and interact with these models locally.
• Any output generated by a given model is a product of that model's own training and design, not of Earthscale. Earthscale makes no representation regarding, and assumes no responsibility for, the training data, biases, licensing terms, or behavior of any third-party model made available through the App.
• All Earthscale trademarks, logos, app design, and original software code are the property of Earthscale's creator(s) and may not be used without permission.

• Certain features (e.g., Reasoning Mode, image understanding, the largest local model tier, home-screen widgets) require an active Earthscale Pro subscription, billed and managed entirely through Apple's App Store (StoreKit).
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Manage or cancel your subscription in your Apple ID account settings.
• Payment is charged to your Apple ID account at confirmation of purchase. Refunds are handled solely by Apple in accordance with Apple's own policies — Earthscale cannot directly issue refunds.
• Pricing is subject to change; you will be notified in accordance with Apple's requirements before any change takes effect for your subscription.

You agree not to use Earthscale to:

• Attempt to generate content that is illegal in your jurisdiction, or that exploits, endangers, or sexualizes minors.
• Circumvent, reverse-engineer, or tamper with the App's safety mechanisms.
• Use the App in a way that infringes the rights of any third party, including intellectual property or privacy rights.

Earthscale reserves the right to restrict access to features (including Pro features) for violations of these Terms.

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Earthscale does not warrant that the App will be uninterrupted, error-free, or that any model will run correctly on your specific device.

To the fullest extent permitted by law, Earthscale and its creator(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the App, even if advised of the possibility of such damages.

You must be at least 18 years old to use Earthscale. Earthscale is not intended for use by anyone under 18.

Earthscale may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Vermont, United States of America, without regard to conflict-of-law principles.
